A pharmacy owner indicted as part of the alleged doping ring involving prominent US trainers Jorge Navarro and Jason Servis has pleaded guilty to unlawful distribution of compounded prescription drugs.

Jeremy Delk, owner of Tailor Made Compounding (TMC), is the third individual to plead guilty in the case after Scott Robinson and Sarah Izhaki admitted to their role in distributing adulterated and misbranded drugs in September.

A total of 27 individuals were indicted in March for their alleged part in a conspiracy to manufacture, distribute and administer performance enhancing drugs (PEDs) to racehorses.

Delk, 40, pleaded guilty to one count of unlawfully engaging in wholesale distribution of a prescription drug, without licensing TMC as a wholesale distributor, while TMC pleaded guilty to one count of distributing unapproved new drugs. Delk faces up to ten years in prison and a maximum fine of $250,000.

According to the March indictments, TMC was linked to Medivet Equine and partnered to create substances such as SGF-1000 which were allegedly used by Servis and Navarro.

In intercepted phone calls that form part of the indictment, Servis, who trained Maximum Security to win the inaugural $20 million Saudi Cup this year, claimed he had been using the designer PED “on almost everything”.

Robert Duncan jnr, United States Attorney for the Eastern District of Kentucky, said: “The safety and efficacy of prescription medications is of paramount importance to us all.

“When pharmacies intentionally evade the FDA requirements, they are placing their own interests above those of the patients they are supposed to be serving. The community deserves better, and I commend the work of our law enforcement partners in their diligent efforts to protect the public and disrupt this criminal conduct.”

Delk and TMC are scheduled to be sentenced on February 24 next year. The next sesssion on Servis and Navarro is due to be heard on November 19.
