Wasted journey for Killian Moore as court is too busy to hear drink-drive case

Jump jockey Killian Moore was philosophical on Thursday after travelling from Ireland to face a drink-drive charge, only to find out Cheltenham Magistrates did not have time to hear his case.

The 26-year-old, whose solicitor said the jockey flew over specially, was made to wait all day before the court told him they had too many cases to deal with and his was one of several that needed to be adjourned.

When court chairman Andrew Hedges explained it would not be possible for the trial to go ahead, Moore replied simply: "No problem."

As he is travelling to California next week to work for three months, Moore's trial was fixed by the court for January 8.

The jockey had previously pleaded not guilty to driving an Audi A4 on the B4078 at Dumbleton in Gloucestershire with 59 micrograms of alcohol in 100 millilitres of breath on February 2 this year.

The legal limit is 35 micrograms, but Moore maintains he was not over the limit when he crashed his car on the day, claiming that he walked to a nearby house where he was "plied" with copious amounts of Captain Morgans Rum to cope with the shock of the accident.

Moore's solicitor, Dermot Clarke, said on Thursday he had served the prosecution with a report from a scientist who had calculated how much alcohol would have been in his client's system at the time he was driving.

Clarke said the prosecution had accepted the contents of the report and urged prosecutor Graham Dono to reconsider going ahead with the case, but was allegedly told the prosecutor's boss at the Crown Prosecution Service wished for the case to continue.
